Ramdev Patanjali Ayurved Ltd brought a drug that has been highly
controversial. The drug released by them being Coronil. According to them,
Coronil is a cure for COVID-19. They have claimed this. But there comes a shock
for them as Madras High Court restrained the company to use the trademark
Coronil.
Why did the
court take such a decision?
Following the
pleading of Chennai-based company Arudra Engineering Private Limited, the
interim order was passed by justice C V Karthikeyan which is valid till July
30. According to the company, Coronil is a trademark that they own since 1993
and they claimed it.
What does
Arudra Engineering Private Limited say on this?
The company is
concerned with manufacturing chemicals, sanitizers in order to clean heavy
machinery as well as containment units. As per the company, they have
registered Coronil-213 SPL and Coronil-92B way back in 1993. Also, they say
since then they have been diligently renewing trademark.
They claim to
have right over the trademark and they say it to be valid till 2027.
Also, the
company said and strongly claimed of having the trademark on its products, with
the products present globally. BHEL And Indian Oil is its clients.
What proofs
were there as evidence to support it in favor of the company?
In order to
strengthen their claim, sales bills of their products for the last 5 years were
presented by the petitioner.
The marks that
the company registered were exactly alike to the mark used by Patanjali. Even
though the companies are selling different products, using the trademark which
is identical would still be an infringement of their intellectual property
rights, as per the company.
Also, the
petitioner further added that if they grant permission to Patanjali for using
the mark, it will not only affect their name and fame but also affect the
goodwill that has been created over the mark by them for more than 26 years,
affecting both in domestic as well as international marketing sectors.

ministry say on this?
The Union AYUSH
Ministry, on July 1, said the company was permitted to sell the drugs only as
an immunity booster but not as a cure to COVID-19, following the Coronil drug
launched by Patanjali.

Baba Ramdev,
strongly opined that there were some people who were hurt seeing the rise that
indigenous medicine got. In this way, Baba Ramdev reacted to all the criticisms
going around on Coronil efficacy.
